We reserve the right to make minor changes or updates to these Terms and Conditions without giving notice and at our sole discretion. We therefore ask you to review these stated Terms and Conditions at regular intervals and on your own accord.

This website is related to the promotion of alcohol, and should not be viewed by anyone below the legal age of alcohol consumption. When ordering, you are required to confirm, by accepting the Terms and Conditions, that you are of legal drinking age in your country of residence. Alcohol abuse can lead to alcoholism and health hazards.

If you do not agree with or cannot abide by these Terms and Conditions, including our privacy policy, we ask you to exit this website.

0. Application of the Terms & Conditions

The present conditions apply to the sale of products from the Cognac-Expert website, including Cognac-Expert’s subscription website subscription.cognac-expert.com. The act of placing an order via Cognac-Expert.com or Subscription.Cognac-Expert.com implies complete acceptance, without reservation, of the Terms and Conditions mentioned here. This excludes all other documents such as prospectus and catalogues that are transmitted by Cognac-Expert.com or are present on its website, which have only an indicative worth.

The seller and vendor of the products displayed is Super SARL, Logis de Beaulieu 16190 Poullignac, France. The fact that the vendor does not reiterate the Terms and Conditions does not imply that the vendor will subsequently renounce these conditions.

Our offers are exclusively reserved for private customers only, and exclude distributors, brokers, and merchants.

Texts and pictures presented on our website are provided for information purposes only, and do not form part of our contractual liability under any circumstances.

I. The subscription

There are three different plans with different Cognac quality characteristics. Customers can select different frequencies with these plans: Monthly boxes (12 boxes per year), every other month (6 boxes per year) or quarterly (4 boxes per year).

In every box delivered there are 2 Cognac bottles.

The customer does not know what is in the box, only that there are 2 Cognac bottles (at least 500ml / 50cl per bottle, normally at least 700ml & 70cl per bottle). The content is a surprise and we do not offer return shipping, only in the case of damage.

The customer will be billed depending on the frequency selected: Monthly, every other month or quarterly. We charge the customer’s credit card for the following month, during the last week of each month.

II. Prices and Taxes

Indication

Prices indicated are both in EUR (€), USD ($), and GBP (£). The sale is made in the shown currency. Prices are indicated including taxes, fees, and shipment costs. The price stated on the confirmation order (“checkout”) is the total due amount, and includes all taxes, fees, and shipping costs. Prices for purchases within the European Union include French VAT (20%), all other orders from non-EU countries exclude French VAT.

Please note: Your order may be subject to local alcohol import taxes and duties unknown to us.

It is the customer’s responsibility to be aware of the personal alcohol import rules (including duties and taxes) in their own country. If you purchase from the US, custom clearance and payment of duties, fees, and taxes is serviced through our shipping service provider. Nevertheless, your order may be subject to local taxes and duties depending on the state of the delivery address.

Billing

A detailed bill will be provided by Cognac-Expert.com if requested. All bills will be issued in EUR (€) and will mention French VAT when applicable (if country of destination is within the EU).

All payments are made in EUR (€).

III. Availability of products

The products featured on subscription.cognac-expert.com are available. The customer accepts that shipped products remain a surprise until delivered. If we are unable to deliver a product for any reason, we will refund the customer the total cost of the order. Refunds will be carried out through a refund to your account via the same procedure used for payment.

IV. Costs of carriage

There is no cost of carriage with subscriptions purchased on subscription.cognac-expert.com.

V. Methods and delivery times

Your package will be shipped from rural France to your doorstep. We offer extremely secure and highly professional shipping. It can take up to 2 weeks to deliver a package from France, especially for such a high value product as Cognac. Please bear with us while we get your order to you as soon as humanly possible. As we partner with a third party shipping provider, we are unable to guarantee an exact delivery date.

You will receive a tracking number once your order is on its way.

VI. Payment

Once your order is confirmed, and you have chosen to “Place Order”, the total amount of the ordered goods, including taxes, fees, and shipping costs is paid in full to Cognac-Expert.com‘s bank account. Our payment provider is Stripe. Only once payment is accepted can we ship your order out.

All orders are shipped with global shipping companies (e.g. FedEx) and are also insured against any damage or loss. However, you’re responsible to provide and review the correct shipping details in order to receive your items. If you refuse the item at delivery or if the shipping company is not able to ship it, It’s the customers responsibility to resolve this issue with the corresponding carrier.

Damaged Items
We send lots of bottles and it’s very rare that a bottle is damaged. However, please open your package within 48 hours of arrival to verify that the contents of your package is not damaged.

In case of a damage, in order to claim a refund or a replacement, you have to report the damage within 48 hours after receiving the package. Please send us an e-mail to claim@cognac-expert.com with the following details: Your order Reference or Invoice ID, date and time when you received the package and fotos of the damaged goods. You’ll get a automatic confirmation that it’s received after you have send it.

Please note: If you’re send the claim later than 48 hours of shipment, we’re not able to give you a refund or replacement on a broken or damaged delivery.

VIII. Return policy

Your rights

As stated in article L. 121-16 of the Consumers’ Code, France, you have the right to return goods, at your own cost, in good condition and in the original packaging with the original bill, within seven (7) days (including the day of delivery), to the registered headquarters of the seller and vendor, as indicated above, for exchange or refund. Such rights will be strictly limited to products not used or opened and returned in good condition.

Return expenses

Cognac-Expert.com will not pay for the cost of carriage for goods returns except in the event of either of the two following conditions being fulfilled:

  1. The goods received are not those ordered
  2. It was arranged between both parties in writing, after a damage was reported (see article VII: Carriage and Responsibility).

In either of these two cases, please contact our Customer Service Department – details of which can be found in point XI of these Terms and Condition. They will provide you with details regarding the organization of the return of your product.

IX. Deed of title

Goods remain the property of Super SARL until payment has been received in full and goods have been shipped. Ownership of the goods changes to the purchaser once the good is shipped. Once the goods are being delivered the purchaser is automatically responsible for them. Transfer of ownership of goods therefore implies the transfer of risks.

X. Privacy

At Cognac Expert the privacy of our visitors is of extreme importance to us. We use the highest security measures to guarantee that all of your information remains protected.

Access and rectification rights

In order to provide a quality service that can respond to your needs, we need to record some of your personal details (surname, first name, address). If you wish to change any of the details held on your account, you should write to our Customer Service Department, stating your surname, first name and address.

In accordance with the Information Systems and Liberty Law of 6th January 1978, France, you have the right of access and rectification of the data recorded. According to French law, the processing of such information has been declared to the French CNIL, who have assigned the following number – 1635942 – to Cognac-Expert.com.

Banking information

When you buy online, your bank details are neither stored nor are they visible on the Internet. It is not possible to intercept the information you send. Our payment provider STRIPE has been audited by a PCI-certified auditor, and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available.

XI. Protection of minors and sanitary mentions

In accordance with articles L. 3342-1 and L. 3353-3 of the French Public Health Code, which stipulates that the sale of alcohol to minors under the age of eighteen (18) years of age is strictly forbidden, you are required to confirm that you are over eighteen (18) years of age at the time of ordering. In the case of US orders, you must be 21 years or older.

Cognac-Expert.com reminds you that any abuse of alcohol is dangerous for your health. It should therefore be consumed and enjoyed in moderation. Pregnant women should avoid drinking alcohol, even in small quantities, as it could have serious consequences to the health of the baby.

A contract concluded by a consumer ordering from a country other than France:

These Terms and Conditions are subject to French law. Therefore, any order is exclusively subject to French law. Within the context of interpretation and execution of this contract all litigation will be brought before the applicable jurisdiction as stated by rules of conflict of law and by the directives and the rules of the European Union.
